An Elected Member commits a minor breach if he or she contravenes the Local Government Act (Rules of Conduct) Regulations 2007.

In accordance with the Local Government Act 1995, a complaint of a minor breach is submitted to the Local Government Standards Panel for determination.

The Complaints Register provides details of minor breach complaints which the Local Government Standards Panel finds has occurred and the actions taken. The Complaints Register is published in the interest of accountability and transparency.

Rules of Conduct

The Local Government (Rules of Conduct) Regulations 2007 applies to complaints about an Elected Member of the Shire of Chittering Council arising from an alleged breach of the Local Government (Rules of Conduct) Regulations 2007, made by members of the public other Elected Members. The legislation specifies rules which are intended to prevent Elected Members engaging in inappropriate behaviour such as securing personal advantage, misusing local government resources and improper conduct. The Local Government Standards Panel deals with breaches of these rules of conduct.

The Register of Complaints prescribed under Section 5.121(3) of the Local Government Act 1995, must include the following information:

  1. the name of the council member about whom the complaint is made; and
  2. the name of the person who makes the complaint; and
  3. a description of the minor breach that the standards panel finds has occurred; and
  4. details of the action taken under section 5.110(6)

29 September 2017 Alan Sheridan Donald Gibson SP48 of 2017 On the 15 February 2018, the Local Government Standards Panel found that Cr Donald Gibson breached regulations 7(1)(b) and 10(1)(a) of the Local Government (Rules of Conduct) Regulations 2007 on 28 September 2017 when sending an email to Mr Alan Sheridan, the Shire's CEO, and other Shire Councillors concerning an invoice Cr Gibson had received from the Shire for the use of data on a Shire-issued iPad (the Complaint) At the Ordinary Meeting of Council held on 19 September 2018 Cr Donald Gibson issued a public apology to Mr Sheridan and fellow Councillors in accordance with the directions of the Local Government Standards Panel
17 November 2017 Gordon Houston Donald Gibson SP57 of 2017 On the 8 March 2018, the Local Government Standards Panel found that Cr Donald Gibson breached regulations 4(2), 7(1)(b) and 11(2) of the Local Government (Rules of Conduct) Regulations 2007 on 15 November 2017, when Council was considering a motion concerning Cr Gibson's email account and data allowance. At the Ordinary Meeting of Council held on 19 September 2018 Cr Donald Gibson issued a public apology to Mr Alan Sheridan and fellow Councillors in accordance with the directions of the Local Government Standards Panel
